Habeas corpus application for
terrorist Posada Carriles declared inadmissible
HAVANA, Feb 21 (AIN).—U.S. Judge Phillip Martínez
has qualified as inadmissible the application for
habeas corpus presented by Luis Posada Carriles
before the El Paso Federal Court.
The notorious criminal, the mastermind behind the
sabotage of a Cuban passenger plane in 1976 that
caused 73 deaths, had applied via the habeas corpus
for his conditional release, alleging that the
Department of Homeland Security (DHS) had not
managed to deport him from the country.
There is no explanation as to how Martínez’ reached
his decision, according to a report on the
Cubadebate website.
The federal judge has stated that the application
for conditional release be denied given the charges
against Posada for immigration fraud and also
because the terrorist is no longer under DHS
custody, but that of the federal bailiffs.
This means that the terrorist will remain in custody
on immigration fraud charges while Immigration
maintains his deportation order, but Posada is not
under the judge’s custody.
“By
using legal technicalities, the U.S. government has
managed to keep Posada in prison without having to
certify him as a terrorist, a decision that
postpones the need to have to declare him a
terrorist until the court gives its verdict on the
charges of lying,” José Pertierra, the lawyer who is
representing the Venezuelan government in its
application for Posada Carriles’ extradition,
explained to Cubadebate.
Posada’s trial is set for May 11, 2007 in El Paso,
Texas.
